Acceptable Use Policy
This Acceptable Use Policy (“AUP”) governs the use of all services provided by Möbius Internet, IT & Communications (“Möbius,” “we,” “us”), including managed IT, internet connectivity, VoIP phone, hosting, and related services (the “Services”). It applies to every client and user who accesses the Services through a client’s account.
By using the Services, you agree to this AUP. It is incorporated into and supplements the Master Services Agreement between you and Möbius; where the two conflict, the Master Services Agreement controls. We may update this AUP from time to time, and the current version is always posted here.
Your responsibilities
You are responsible for all activity under your account, including activity by your employees, contractors, and anyone you allow to use the Services. You agree to:
- Keep account credentials confidential and use reasonable security practices.
- Comply with all applicable local, state, and federal laws.
- Promptly notify Möbius of any actual or suspected security breach or misuse.
- Maintain your own backups and security measures except where Möbius is contracted to provide them.
Prohibited activities
You may not use the Services to:
Illegal or harmful conduct
- Violate any law, regulation, or third-party right.
- Store or transmit material that is unlawful, defamatory, fraudulent, obscene, or that exploits or endangers minors.
- Infringe copyrights, trademarks, patents, or trade secrets, including unauthorized distribution of copyrighted media or software.
Security and network abuse
- Gain or attempt to gain unauthorized access to any system, network, account, or data.
- Distribute malware, ransomware, viruses, or other malicious code.
- Conduct port scanning, vulnerability scanning, penetration testing, or denial-of-service activity without prior written authorization.
- Forge or manipulate headers, identifiers, IP addresses, or routing information.
- Circumvent access controls, usage limits, or authentication mechanisms.
Email and messaging abuse
- Send unsolicited bulk or commercial email (spam) or facilitate its transmission.
- Send messages in violation of the CAN-SPAM Act or other anti-spam laws.
- Harvest email addresses or operate mailing lists without proper consent.
Telephone and VoIP abuse
- Place unlawful robocalls or autodialed/prerecorded calls in violation of the TCPA or related rules.
- Engage in caller-ID spoofing, toll fraud, traffic pumping, or any fraudulent calling practice.
- Misrepresent the registered service location used for 911 (E911) purposes.
Network integrity and fair use
- Resell or redistribute the Services without our written authorization.
- Use connectivity in a way that disrupts, degrades, or interferes with the network or other users.
- Generate traffic that exceeds the reasonable, intended use described in your Service Order.
Network management
To keep service reliable for all clients, we may apply reasonable network management practices, including prioritizing traffic, mitigating attacks, and addressing congestion — consistent with applicable law and your Service Order.
Internet and VoIP service notes
- Internet connectivity may be delivered over Möbius infrastructure or resold from third-party carriers. Where service is resold, the underlying carrier’s terms also apply.
- VoIP service depends on a working internet connection and power. 911 service over VoIP behaves differently than traditional phone service; clients must keep their registered service address current and acknowledge the limitations described in the VoIP Addendum.
Monitoring and privacy
We do not routinely monitor the content of client traffic, and we respect the confidentiality of your data as described in the Master Services Agreement. We may investigate suspected violations and access account or traffic data where necessary to operate the Services, ensure security, comply with law, or respond to lawful requests.
Enforcement
When we believe this AUP has been violated, we may — with or without notice depending on severity — ask you to correct the issue; filter, restrict, suspend, or terminate the affected Service or account; remove offending material; and cooperate with law enforcement. We use reasonable judgment and, wherever practical, give you a chance to address a problem first. Urgent threats to the network or other users may require immediate action.
Reporting violations
To report suspected abuse, security issues, or violations of this AUP, contact abuse@mobiusisit.com or call 225-490-5600.
Changes to this policy
We may revise this AUP to reflect changes in our Services, the law, or industry practice. Material changes will be posted here with an updated effective date. Continued use of the Services after changes take effect constitutes acceptance of the revised AUP.
This Acceptable Use Policy is a template and should be reviewed by qualified legal counsel before publication, particularly regarding telecommunications, broadband, and 911 obligations applicable to your service lines.
